Terms of Service
In short: Use markoto for any lawful purpose. Don’t break it, don’t abuse it, don’t impersonate. We can suspend accounts that do.
1. The service
markoto is a collaborative markdown editor operated by LatentSpace Labs GmbH. Your use of the service is governed by these Terms, our Privacy Policy (/legal/privacy), and — for workspace customers — our Data Processing Addendum (/legal/dpa).
2. Eligibility
You must be at least the digital age of consent in your country (16 in most EU member states) to create an account. If you are using markoto on behalf of an organisation, you confirm you are authorised to bind that organisation.
3. Your account
You are responsible for the security of your account credentials. We use OAuth via GitHub or Google for authentication; you should secure those upstream accounts with two-factor authentication.
4. Acceptable use
You agree not to use markoto to:
- Upload, store, or transmit content that is illegal under EU law or the law of your country;
- Infringe third-party intellectual property rights;
- Harass, threaten, or impersonate any person;
- Attempt to circumvent our rate limits, sub-processor protections, or audit logging;
- Use the AI features to generate or distribute disallowed content (CSAM, terrorist content, malware).
We may suspend or terminate accounts that violate these terms.
5. Content ownership
You own the documents and content you create on markoto. You grant us the limited licence required to host, sync, render, and back up your content for the purpose of operating the service.
We do not use your content to train AI models. Our AI sub-processors (Mistral AI, Jina AI, Black Forest Labs — see /legal/sub-processors for the full list) do not use API content to train models on the tiers we use.
6. AI features
The AI assistant offers suggestions; you choose to accept or reject them. AI output may be incomplete or inaccurate. You are responsible for reviewing AI-generated content before publishing it.
7. Reporting illegal content
To report content that violates EU law or these Terms, see our abuse-reporting policy at /legal/abuse-policy. We acknowledge every report and act on those that meet our policy. This is our notice-and-action mechanism under Article 16 of the Digital Services Act.
8. Service availability
We aim for high availability but do not promise uptime guarantees outside of paid commercial tiers. Maintenance windows may briefly interrupt service.
9. Liability
To the maximum extent permitted by EU consumer-protection law, our liability is limited to the fees you paid for the service in the 12 months prior to the event giving rise to the claim. Nothing in these Terms limits liability for gross negligence, wilful misconduct, or matters that cannot be limited by law.
10. Termination
You may terminate your account at any time from /settings/profile. We may terminate accounts that breach these Terms, with notice where reasonable. On termination, your data is processed according to the Privacy Policy.
11. Governing law and forum
These Terms are governed by Swiss law. Where you are a consumer, you also benefit from any mandatory consumer-protection provisions of the law of your habitual residence.
12. Changes
This is version 1, effective 2026-05-04. Material changes trigger a re-acceptance prompt.
